Durable Power of Attorney (DPOA)
Is a legal instrument used to delegate power to another. The person who signs or executes the Durable Power of Attorney is called the principal. The person who receives the legal authority to make property, financial and legal decisions for the principal is called the agent or attorney-in-fact. The principal can give broad or very limited legal authority to the agent.
A "Durable" Power of Attorney allows the agent to act for the principal even when the principal is mentally incompetent or physically unable to make decisions. It may also be used immediately, and is effective until the principal rescinds it or the principal's death.
The form should have the title of "Durable" Power of Attorney and say, "The powers you grant below continue to be effective should you become disabled or incompetent".
